These Terms & Conditions govern your access and use of the Viopa Holiday website, mobile site, and related services (collectively, the 'Platform'). By accessing or using the Platform, creating an account, or completing a booking, you agree to be legally bound by these Terms. If you do not agree, do not use the Platform.

2. Booking Process

• Viopa Holiday acts as an intermediary and booking agent; the accommodation contract is between you and the property provider.
• Availability is not guaranteed until you receive a written confirmation.
• Special requests are not guaranteed unless explicitly confirmed.
• Taxes, fees, and charges (including cleaning fees, city taxes, and security deposits) may apply and are shown before payment where applicable.
• Currency conversion and exchange rates may affect the final amount; your bank may charge additional fees.
• You must review the listing-specific cancellation and refund policy before booking.

3. User Obligations

• Provide accurate, current, and complete information.
• You must be 18 or older to book; minors may stay only with a responsible adult.
• Comply with all house rules, building rules, and applicable laws.
• Prohibited uses include parties, events, illegal activities, subletting, and exceeding occupancy limits.
• You are responsible for damages, lost keys, unpaid charges, and additional cleaning caused by you or your guests.
• Report issues within 24 hours of check-in so we can assist.
• Keep your account credentials secure and notify us of any suspected unauthorized use.

4. Payments and Refunds

• Payments are processed by our payment partners using secure methods.
• We may place a pre-authorization or charge a refundable deposit to cover potential damages or extra costs.
• All prices are shown per listing; unless stated otherwise, taxes and fees may be additional.
• Refunds, if applicable, are sent to the original payment method; timings depend on your bank (typically 5–10 business days).
• Chargebacks or disputes may result in cancellation and account limitations.
• In case of no-show or early departure, refunds are governed by the listing's policy.

5. Data Protection

• We process personal data as a controller in accordance with the GDPR where applicable.
• Legal bases include performance of a contract, legitimate interests, and compliance with legal obligations.

6. Intellectual Property

• The Platform, logo, content, and software are owned by or licensed to Viopa Holiday.
• You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes.
• You may not copy, scrape, reverse engineer, or use content without permission.

7. Liability Disclaimer

• We are not the owner or operator of accommodations; providers are solely responsible for their properties and services.
• To the maximum extent permitted by law, we disclaim all warranties and limit our liability to the amount you paid for the affected booking.
• We are not liable for indirect, incidental, or consequential damages.
• Force majeure events beyond our control may affect availability; we are not liable for such events.

8. Governing Law

• These Terms are governed by the laws of the Turkish Republic of Northern Cyprus. Where EU consumer laws apply, you retain any mandatory protections.
• Courts in Nicosia, TRNC, shall have jurisdiction, subject to applicable consumer law.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by posting the updated version and updating the Effective Date.
Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

11. House Rules and Damage Policy

• No smoking unless the listing expressly permits it.
• No pets unless the listing allows them.
• Respect neighbors and observe any quiet hours.
• A damage deposit may be required and withheld for rule violations or damage.

12. Reviews and Content

• You may submit reviews and other content you own; you grant us a worldwide, royalty-free license to use and display such content in connection with the Platform.
• Reviews must be honest, lawful, and respectful; we may moderate or remove content at our discretion.

13. Complaints and Dispute Resolution

• If you experience an issue, contact us first; we'll try to resolve it promptly with the property provider.
• If not resolved, you may pursue remedies available under applicable laws.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
